Our store uses a shopping-cart system. You can add items to buy them, modify
your shopping cart to remove items or change quantities, and finally proceed
to checkout. Our exclusive order entry system allows us to process orders
promptly. Orders placed through our online store are processed automatically
and therefore faster than orders placed by fax or e-mail because processing
is not dependent on our customer service center's business hours.

Specifications, and Technical Information
Drawings,
specifications, designs, and other technical information furnished to Buyer
by Seller shall remain the property of Seller. Without Seller’s prior written
consent, Buyer shall not use, duplicate or disclose any technical data delivered
or disclosed by Seller to Buyer for any purpose other than for installation,
operation or maintenance of goods purchased by Buyer.

Typographical Errors
While we make every effort to ensure the products information and pricing
on our website is accurate and current, there may be instances where inaccurate
or incomplete data is displayed. In the event that item data is incorrect,
such as listed with an incorrect price, availability, or with incorrect
information, TVI Electronics shall have the right, at our sole discretion,
to refuse or cancel any orders placed for that item. In the event an item
is mispriced, TVI Electronics, at our sole discretion, will do one of the
following:
a) If an item is priced lower then the displayed price, you will be charged
the lower amount and we will ship the item.
b) If an item is priced higher than the stated amount, we will either contact
you for instructions or cancel your order and notify you of such cancellation.
If we cancel your order after your payment has been processed, we will issue
you a full refund.
We reserve the right to correct and/or update the content on our website
at anytime without notice.

Online Coupon Codes
Occasionally, TVI Electronics may present offers through online Coupon Codes.
These online coupons are extremely time sensitive and are for qualifying
online orders only. In order to receive the discount, you must click on
"Click Here to Enter a Coupon!" on the online Order Summary page. After
entering the coupon code exactly as it was presented to you, click on the
"Submit Coupon" button. Then you may proceed to checkout as if you were
placing a standard online order.

Minimum Order Quantity
You will notice that some of our products have a minimum order quantity.
This is the minimum quantity that must be purchased for that particular
product. Products with a minimum order quantity suit customers who purchase
large quantities in a single order to gain a price advantage. The minimum
order quantity is specified when viewing the details of a selected product.

Order Acceptance Policy
Your receipt of an electronic or other form of order confirmation does not
signify our acceptance of your order, nor does it constitute confirmation
of our offer to sell. TVI Electronics reserves the right at any time after
receipt of your order to accept or decline your order for any reason and
to limit quantity on any and all products. The charges at checkout may not
be final. We may contact you regarding adjustments to your order, including
but not limited to tax and shipping.
We will do everything possible to provide excellent customer service. However,
TVI Electronics reserves the right to refuse a sale or service in certain
instances. These include shipping to countries known to have high internet
fraud rates and selling to customers whose conduct or communication opens
questions of possibly high-risk transactions. All orders placed will be
thoroughly researched before shipping in accordance with the policies set
by TVI Electronics Credit and Fraud Avoidance Department. TVI Electronics
may require additional information and/or verification before accepting
and processing any order.

Credit Cards
TVI Electronics accepts all major types of credit cards: VISA, MasterCard,
Discover and American Express. Please be sure to carefully fill out all
personal information fields in the order form to avoid delays in processing
your order.

Purchase Order Application
This payment method is only for US businesses and individuals who have already
established a credit account with TVI Electronics. Please note that our
minimum opening order for new accounts is $250.00 and the minimum for subsequent
orders is $100.00. Orders that do not meet these minimums should be on credit
card. Unfortunately, we are unable to accept purchase orders from private
or international customers.
You may purchase
with a Purchase Order by creating a Purchase Order Credit Account with us.

page. Once your application has been approved by TVI Electronics, you will
be able to use your credit to place your Purchase Orders.
All purchase
orders of Buyer shall, unless otherwise agreed in writing by Seller, be
in writing and shall set forth the quantity of the Goods desired, the model
number or type of Goods, the desired delivery date, the price, and all relevant
information necessary to effectuate shipment of the Goods by Seller. All
purchase orders shall be subject to acceptance of these terms and conditions
of sale, and no additional, inconsistent or contrary terms shall become
part of this agreement or any sale of Goods to Buyer. The terms and conditions
listed herein shall be made a part of any agreement made between Buyer and
Seller and shall have precedence over any terms and conditions proposed
by Buyer in a purchase order or other writing.
Unless otherwise specified, payment by Buyer shall be made within 30 days
of the invoice date. At no time will credit terms in excess of net thirty
(30) days from the date of Seller's invoice be granted without Seller's
written approval. Seller reserves the right to charge interest at the rate
of 2% per month (but not more than the maximum percentage permitted by law)
on all balances not paid by Buyer within the designated net terms. Payment
of Seller's invoices are not subject to adjustment for any reason.

Fax Order In
If you prefer, choose "Fax Credit Card Authorization" from the payment methods
window. Print out the form and fill in all the required information. Please
be sure to carefully fill out all personal and credit card information fields
in the order form to avoid delays in processing your order. Fax the completed
form to the number printed on the form.

Direct Bank Funds Transfer (Direct
Credit / EFT / Bank Wire Transfer)
TVI Electronics also accepts payments via direct bank deposits. Please note
that wire transfer payments usually take 3-5 business days to clear. We
will not ship your order until your payment is verified by our bank. A record
of the transaction from your bank is not sufficient to release an order.
DO NOT send money to any bank account other than the one provided with your
order. TVI Electronics is not liable for any money loss or delay in delivery
due to money sent to incorrect bank account. Please do not forget to mention
your [Order No: xxx] in the transaction remark when transferring from your
Bank Account.
Domestic Bank Wire Transfer:
USA Compass Bank charges us $16 USD per incoming wire transfer, so we ask
that you add this fee to the invoiced purchase price of your order. This
covers our bank fees and the cost of handling transaction failures. These
fees are unavoidable.
International Bank Wire Transfer:
International wire transfers typically involve a minimum of three banking
institutions: the originating bank, an intermediary bank, and a receiving
bank. Your bank (originating bank) will typically charge a service fee to
initiate the wire transfer as will any intermediary banks that assist with
the wire transfer.
Typically, an intermediary bank in the destination country will deduct a
third fee from the transfer amount that the customer requested, and the
vendor (TVI Electronics) does not receive the full amount that you requested.
Therefore, in additional to $16 USD per incoming wire transfer charged to
us (TVI Electronics, the vendor) by the receiving bank, we ask that you
add $22 USD to the invoiced purchase price to cover the intermediary bank's
fee. This will ensure that when we receive the wire transfer, the amount
will be sufficient to cover your product's cost & freight fee. Under no
circumstances will TVI Electronics absorb the intermediary bank's fee from
the invoiced purchase price.

Backorders
We take every effort to ensure adequate stock at TVI Electronics, but there
is always a possibility that an item you requested is not in stock at the
time you make your purchase. All stock items are subject to prior sale and
will be confirmed at time order is placed. "In Stock" items cannot be canceled
after order completion.
TVI Electronics will accept orders for "Out of stock" items. If an item
in your order is not in stock, it will be placed on backorder and shipped
to you when it becomes available. You will be charged for items on backorder
at the time you place your order. If you do not want to be charged for backordered
items, please indicate that in the Customer's Comments box during checkout.
In this case we will not be able to ship backordered items before you pay
your order in full. Shipping charges are non-refundable. A backorder may
be canceled at any time prior to shipping.

Lead Time
The lead (production) time of a product largely depends on the quantity
you are ordering and if a product is in stock. Production times are not
guaranteed and offer an estimate. The initial product details page of your
selected product gives the estimated lead time to acquire the product. Your
Sales Consultant can assist you with production time expectations. As a
guide allow 2-3 weeks for smaller quantities of product. If any further
delays are anticipated, you will be notified via e-mail or phone. Please
note the estimated production time does not include the delivery transit
times.

Sales Tax
TVI Electronics only charges sales tax on orders to be delivered to addresses
within the state of Texas. Buyer is responsible for any and all unpaid sales
taxes. If you are a Reseller or Non-Profit organization and are tax exempt
certified, you are eligible to have your TVI Electronics account flagged
as tax exempt. So ensure your TVI Electronics account is tax exempt before
completing your next order as any order that displays tax being charged
during checkout is non-refundable.
Create an account at the TVI Electronics website if you have not already
done so by clicking on the

link and filling in the required fields. For Texas Tax Exempt customers:
download and complete the
01-3392 (Tax Exempt
Certificate) form. You can fax this form to our Sales department at (281)
419-3332 or you can email it to

that the company name on your account exactly matches the company name that
is listed on your tax exempt certificate and that the paperwork you provide
is complete.

International Orders
International orders may be subject to local import fees, customs, duty,
or additional taxes in the country of destination. TVI Electronics is not
responsible for, nor can offer any specific advice on import fees, duty,
customs, or taxes that you may have to pay when your merchandise arrives.
TVI Electronics recommends that you contact your customs import office for
more information about potential charges. TVI Electronics is not responsible
for any taxes, duty, customs fees or shipping charges on any item being
returned.

Changes
Subject to
acceptance or rejection by Seller, Buyer may issue written change notices
relating to the volume of the Goods ordered. Such changes issued by Buyer
are restricted to: (a) increases in required quantity; (b) shipment schedule
changes falling outside the Seller's production cycle (i.e., schedule changes
must be implemented no earlier than the previously committed delivery date);
(c) changes in place of delivery (with prior notice before the scheduled
shipment) and (d) changes in method of shipment or type of packaging (with
prior notice before the scheduled shipment). Shipments on an order may be
"pushed out" or delayed one time only, up to a maximum of two weeks. No
other change orders shall be permitted without prior written approval of
Seller.

Order Cancellation
Only orders, submitted through this website for in stock Standard Goods,
may be cancelled prior to the scheduled shipment date (refer to the
cut-off times), unless otherwise specified in negotiated agreements
(i.e., a non-cancelable, non-stock adjustable purchase agreement is specified).
You MUST use our
Order Cancellation Form
or call us to cancel your order. Cancelling an order via e-mail will just
get you an e-mail instructing you to use the Order Cancellation Form. This
is not to hassle you at all, but we must have specific information for cancellations
and refunds.
If the item
is not in stock, the order may be cancelled prior the shipping date by submitting
Order Cancellation Form
or by calling our Customer Service.
A cancellation
fee of 15% of the purchase amount of the canceled Standard Goods
will be applied to your credit card.
This charge exists to cover expenses incurred in ordering of the goods,
and packaging costs. This charge may be waived on the conditions of the
order and assessment by management.
Buyer may
not cancel custom orders for Non-Standard Goods at any time after order
placement and will be liable for the entire purchase amount. See
Custom/Special Orders.
Unfortunately,
we are not able to cancel orders once they have been shipped. Please refer
to our
Return Policy
for easy returns.

Custom/Special Orders
A Custom
order is an item that we do not stock and that is ordered or manufactured
by TVI Electronics for the customer’s specific needs. If buyer’s order requests
a custom finish on the goods, the order shall be considered non-cancellable
and all goods are non-returnable or exchangeable. Buyer is responsible for
the costs of the goods and expenses incurred in production of the custom
goods, including, but not limited to, the cost of the fixtures, the costs
of non-stock parts, the labor, and overhead incurred in the production of
custom order.
Cancellation of a custom/special order, once the project has started or
been completed, forfeits the return of prepayments and deposits in order
for TVI Electronics to recoup its costs. Due to the custom nature of these
products unfortunately we must charge a 50% restocking fee should the order
need to be cancelled for any reason.
In the event the customer refuses to accept shipment or fails to make any
payment when due, TVI Electronics may take immediate possession of any of
the goods and may suspend or cancel shipment to customer. TVI Electronics
also has a right to retain the possession of the goods until the claim is
paid. If the order is still unclaimed after a one month period, TVI Electronics
will take a full possession of the goods, which means if Buyer will decide
to claim his/her order in the future, he/she will need to pay a full amount.

Applicable Law and Forum
The validity,
performance and construction of the
agreement between
Seller and Buyer shall be governed by the laws of the state in which
Seller resides, and such state shall be the only jurisdiction in which any
suit may be brought against Seller regarding any dispute arising of this
transaction.

Indemnification
Purchaser
shall indemnify, hold harmless, and defend Seller, and its employees from
and against any and all costs, claims, suits, liabilities, damages, and
expenses of any kind whatsoever (including, but not limited to, court costs
and reasonable attorneys’ fees), incurred or suffered as a result of Purchaser’s
late payment or non-payment (including the costs of collection), misuse
or alteration of the Goods, or design of Goods selected by Purchaser or
of custom Goods.
